These terms apply to sawyertrailers.com (the “Website”) and the Sawyer Trailers dealer portal (the “Portal”), operated by Sawyer Trailers LLC (“Sawyer Trailers,” “we,” “us,” or “our”). By using the Website or Portal, you agree to these terms. If you don’t agree, please don’t use them.

2. How Sawyer trailers are sold

Sawyer Trailers sells through authorized dealers. The Website doesn’t sell trailers or take payments. Purchases are made with a dealer, under the dealer’s own terms.

3. Product information

We work to keep specifications, standard features, photos, and color samples accurate, but they’re for general information and may change without notice. Colors on screen are approximations of the actual finish. Configurator drawings are illustrations, not exact representations. Confirm the specifications for a specific trailer with your dealer before you buy.

4. Quotes, pricing, and availability

The Website doesn’t publish prices. Any quote, price, or availability you receive from Sawyer Trailers or a dealer is not binding until it’s confirmed in a written agreement or purchase contract, and may change or be withdrawn before then.

5. The dealer portal

The Portal is for authorized Sawyer dealers and the people they invite. If you have a Portal login:

• You’re responsible for keeping your password private and for activity under your login
• Only invite people who work for your dealership, and turn off access when someone leaves
• Dealer pricing, program terms, and other Portal information are confidential and may not be shared outside your dealership
• Orders placed in the Portal are requests until Sawyer Trailers accepts them, and are governed by your Authorized Dealer Agreement. If these terms and your dealer agreement conflict, the dealer agreement controls
• We may suspend or end Portal access, including if a dealer agreement ends or these terms aren’t followed

6. Acceptable use

Don’t misuse the Website or Portal. That includes trying to access accounts or data that aren’t yours, interfering with or overloading the service, scraping or copying content in bulk, uploading anything unlawful or harmful, or using the Website to send spam.

7. Intellectual property

The Sawyer Trailers name, logo, photos, text, and designs on the Website are owned by Sawyer Trailers LLC or used with permission. Authorized dealers may use them as allowed by their dealer agreement. Otherwise, please don’t copy or reuse them without our written permission.

8. What you send us

When you submit a form or upload content, you confirm the information is accurate and that you have the right to share it. You allow us to use it to respond to you and run our business, as described in our Privacy Policy.

9. Other websites

Links to other sites, such as dealer websites or maps, are provided for convenience. We aren’t responsible for their content or practices.

10. Disclaimer

The Website and Portal are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the Website and Portal, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we don’t promise they’ll be uninterrupted or error-free. This doesn’t change any written warranty that comes with a Sawyer trailer.

11. Limitation of liability

To the fullest extent the law allows, Sawyer Trailers LLC isn’t liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Website or Portal. This section doesn’t limit any rights you have under a trailer’s written warranty or that can’t be limited by law.

12. Indemnification

You agree to defend and indemnify Sawyer Trailers LLC and its owners, employees, and affiliates against claims arising from your misuse of the Website or Portal, your violation of these terms, or your violation of the law or someone else’s rights.

Our Privacy Policy explains how we handle personal information and is part of these terms.

14. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any legal action about the Website or Portal must be brought in the state or federal courts located in Texas, and you consent to their jurisdiction. Disputes between Sawyer Trailers and a dealer are governed by the dispute terms in the dealer agreement.

15. Changes

We may update these terms by posting a new version here with a new date. Continuing to use the Website or Portal after a change means you accept the updated terms.

16. General

If any part of these terms can’t be enforced, the rest stays in effect. Our not enforcing a provision isn’t a waiver of it.
